1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of the website at psigenei.com, the Test Manthan platform, and all related services, content, and features (collectively, the "Platform") operated by PSIGENEI EdTech Services LLP ("PSIGENEI", "we", "us", or "our").
By creating an account, accessing, or using the Platform in any manner, you ("you", "your", or "User") agree to be bound by these Terms, our Privacy Policy, and our Refund Policy, all of which are incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Platform.
2. Account Registration and Security
2.1 Account Creation
You must create an account to access paid features of the Platform. You agree to provide truthful, accurate, and current information during registration and to update such information if it changes.
2.2 One Account Per User
Each user may maintain only one account. Creating multiple accounts to circumvent restrictions, exploit promotions, or for any other purpose is prohibited and may result in termination of all associated accounts.
2.3 Account Security
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at psigenei@gmail.com if you become aware of any unauthorised use of your account. PSIGENEI is not liable for any loss or damage arising from your failure to maintain account security.
2.4 Account Sharing
Your account and subscription are personal to you and may not be shared with, transferred to, or used by any other individual. Sharing of login credentials is a violation of these Terms and may result in immediate account termination without refund.
3. Intellectual Property Rights
3.1 Ownership
All content available on the Platform, including but not limited to the following, is the exclusive intellectual property of PSIGENEI EdTech Services LLP and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable intellectual property laws of India:
- Questions, answer keys, explanations, and solutions, created by our team of subject matter experts and content developers.
- Syllabus maps, topic taxonomies, subject classification systems, and bucket code structures.
- Previous year question (PYQ) compilations, e-books, and study materials, including their selection, arrangement, formatting, tagging, and presentation.
- Test papers, mock examinations, and customised test configurations.
- Course content, video lectures, written materials, notes, and tutorials.
- The Test Manthan platform, including its user interface, design, layout, visual elements, logos, and graphics.
- The names "PSIGENEI", "Test Manthan", and all associated brand names, logos, taglines, and trademarks (registered or unregistered).
- Software, algorithms, code, databases, and the underlying technology of the Platform.
- Blog posts, articles, social media content, and any other written or visual content published by PSIGENEI.
3.2 Limited License to Users
Subject to your compliance with these Terms and payment of applicable subscription fees, PSIGENEI grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Platform and its content solely for your personal, non-commercial educational purposes.
This license does not include the right to:
- Copy, reproduce, download, screenshot, screen-record, or duplicate any content from the Platform, in whole or in part, except as transiently necessary to view the content on your device.
- Distribute, share, publish, broadcast, or make available any content from the Platform to any third party, whether for free or for a fee, through any medium including but not limited to messaging applications, social media, file-sharing platforms, Telegram channels, email, or physical reproduction.
- Modify, adapt, translate, reverse-engineer, decompile, or create derivative works based on any content or technology of the Platform.
- Use any content from the Platform for commercial purposes, including but not limited to creating competing educational products, coaching materials, question banks, or study resources.
- Remove, alter, or obscure any copyright notices, watermarks, trademarks, or other proprietary markings from any content.
- Use automated tools, bots, scrapers, crawlers, or any data extraction technology to access, collect, or harvest content or data from the Platform.
3.3 Trademark
"PSIGENEI" is a trademark of PSIGENEI EdTech Services LLP. "Test Manthan" and all associated branding are trademarks of PSIGENEI. Unauthorised use of these marks, including in domain names, social media handles, business names, or advertising, is strictly prohibited.
3.4 Enforcement
PSIGENEI actively monitors for and takes action against intellectual property infringement. If you become aware of any unauthorised use of PSIGENEI's intellectual property, please report it to psigenei@gmail.com. PSIGENEI reserves the right to pursue all available legal remedies, including injunctive relief and damages, against individuals or entities found to be infringing its intellectual property rights.
3.5 Third-Party Intellectual Property
The Platform may reference examination names such as CSIR NET, GATE, IIT JAM, GAT-B, DBT JRF, TIFR, and CUET PG. These names are the property of their respective organising bodies (CSIR, IIT, NBHM, DBT, TIFR, NTA, etc.) and are used on the Platform solely for descriptive and informational purposes. PSIGENEI is not affiliated with, endorsed by, or officially connected to any of these examination bodies unless expressly stated.
3.6 Infringement Reporting
If you believe that any content on the Platform infringes your intellectual property rights, you may submit a written notice to us at psigenei@gmail.com with the following information: (a) identification of the copyrighted work or trademark claimed to be infringed; (b) identification of the material on the Platform that you claim is infringing; (c) your contact information; and (d) a statement that you have a good faith belief that the use is not authorised by the rights owner. PSIGENEI will review all valid notices and take appropriate action, which may include removal of the allegedly infringing content.
4. Subscriptions and Payments
4.1 Subscription Plans
Access to certain features and content on the Platform requires a paid subscription. Details of available plans, pricing, and features are displayed on the Platform at the time of purchase.
4.2 Payment Processing
All payments are processed securely through Razorpay. By making a payment, you agree to Razorpay's terms of service. PSIGENEI does not store your credit card, debit card, or UPI credentials.
4.3 Pricing
All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. PSIGENEI reserves the right to modify pricing at any time. Price changes will not affect active subscriptions that have already been paid for.
4.4 Refund Policy
Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference.
5. Prohibited Conduct
You agree not to:
- Share your account credentials with any other person or allow any other person to use your account.
- Copy, reproduce, distribute, or publicly display any content from the Platform, whether in digital or physical form.
- Use any automated means (including bots, scrapers, spiders, or browser extensions) to access, download, or collect content or data from the Platform.
- Attempt to gain unauthorised access to any part of the Platform, its servers, databases, or any connected systems.
- Interfere with or disrupt the Platform, its servers, or networks, including through denial-of-service attacks, malware, or other harmful code.
- Use the Platform to transmit spam, phishing attempts, or unsolicited commercial communications.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.
- Resell, sublicense, or commercially exploit access to the Platform or any content therein.
- Upload, post, or transmit any content that is defamatory, obscene, hateful, threatening, or otherwise objectionable.
- Circumvent or attempt to circumvent any access controls, digital rights management, or security measures implemented on the Platform.
6. User-Generated Content
6.1 Applicability
If the Platform allows you to post, submit, or share any content (such as reviews, feedback, forum posts, or comments) ("User Content"), the terms in this section apply.
6.2 Your Responsibility
You are solely responsible for any User Content you post. You represent and warrant that you own or have the necessary rights to post such content, and that it does not infringe the intellectual property or other rights of any third party.
6.3 License to PSIGENEI
By posting User Content on the Platform, you grant PSIGENEI a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, display, and distribute such content in connection with the Platform and PSIGENEI's business, including for promotional and marketing purposes.
6.4 Right to Remove
PSIGENEI reserves the right to remove or disable any User Content at its sole discretion, without prior notice, if it violates these Terms or is otherwise objectionable.
7. Disclaimers
7.1 No Guarantee of Results
PSIGENEI provides educational tools and resources designed to assist in competitive examination preparation. We do not guarantee any specific outcome, result, rank, or score in any examination. Success in competitive examinations depends on numerous factors beyond the scope of any single preparation platform.
7.2 Platform Provided "As Is"
The Platform and all content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
7.3 Content Accuracy
While we strive to ensure that all content on the Platform is accurate, complete, and up to date, we do not warrant that it is free from errors. Examination syllabi, patterns, and regulations are subject to change by the respective examination bodies, and PSIGENEI cannot guarantee that the Platform will reflect such changes in real time.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- PSIGENEI's total liability to you for any claims arising from or related to your use of the Platform shall not exceed the amount you have paid to PSIGENEI in the twelve (12) months immediately preceding the event giving rise to the claim.
- In no event shall PSIGENEI, its founders, partners, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Platform.
9. Indemnification
You agree to indemnify, defend, and hold harmless PSIGENEI, its founders, partners, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Platform in violation of these Terms.
- Your infringement of any intellectual property or other rights of any third party.
- Any content you post or submit through the Platform.
- Your violation of any applicable law or regulation.
10. Termination
10.1 Termination by You
You may terminate your account at any time by contacting us at psigenei@gmail.com or through the account settings on the Platform. Termination of your account does not entitle you to a refund unless expressly provided for in our Refund Policy.
10.2 Termination by PSIGENEI
PSIGENEI reserves the right to suspend or terminate your account and access to the Platform, without prior notice and without refund, if:
- You violate any provision of these Terms.
- We reasonably believe that your account is being used for fraudulent, abusive, or unlawful purposes.
- We are required to do so by law or regulatory order.
- We discontinue the Platform or any part thereof.
10.3 Effect of Termination
Upon termination, your license to access the Platform and its content is immediately revoked. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law) shall survive.
11. Modifications to Terms
PSIGENEI reserves the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where practicable, notify you via email or a notice on the Platform.
Your continued use of the Platform after the updated Terms are posted constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must stop using the Platform and may request account deletion.
12. Dispute Resolution
12.1 Informal Resolution
In the event of any dispute, claim, or controversy arising from these Terms or your use of the Platform, you agree to first attempt to resolve the matter informally by contacting us at psigenei@gmail.com. We will endeavour to resolve your concern within 30 days.
12.2 Arbitration
If informal resolution is unsuccessful, any dispute shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be conducted by a sole arbitrator mutually agreed upon by both parties. The seat and venue of arbitration shall be Gaya, Bihar. The language of arbitration shall be English.
12.3 Jurisdiction
Subject to the arbitration clause above, the courts in Gaya, Bihar shall have exclusive jurisdiction over any disputes arising from or relating to these Terms or the Platform.
13. General Provisions
13.1 Entire Agreement
These Terms, together with the Privacy Policy and Refund Policy (available on the Platform), constitute the entire agreement between you and PSIGENEI regarding your use of the Platform. They supersede all prior agreements, communications, and understandings.
13.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
13.3 Waiver
The failure of PSIGENEI to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
13.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. PSIGENEI may assign its rights and obligations without restriction.
13.5 Force Majeure
PSIGENEI shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, government actions, internet or telecommunications failures, power outages, or pandemics.
